Optimum Assessment is a trade name of Citrus Andriessen BV. This privacy statement applies to all Optimum Assessment websites including www.optimumassessment.com. There is a clear link to this privacy statement on this active website.

The General Data Protection Regulation (AVG) requires organizations that process personal data to provide clear information to data subjects (those whose data is being processed) about that processing. Through this statement, Optimum Assessment, as the responsible party, fulfills this information requirement.

Optimum Assessment attaches great importance to the proper and careful handling and security of personal data. The organization therefore complies with all requirements of national and European privacy legislation.

What will your personal information be used for?

Your personal data provided through the website, by email or in writing may be used by Optimum Assessment for the following purposes:

  • (being able to) make contact, including for customer satisfaction surveys or market research, or (being able to) answer questions asked or provide advice/information upon request ;
  • Processing (open) applications or responses to job openings;
  • subscription to and mailing of our newsletter by email and/or other content publications;
  • In support of products or services you have purchased from us;
  • Gaining insight into the use of our website;
  • improving and evaluating our website and services;
  • For keeping proper records and necessary internal management;
  • handling (or being able to handle) complaints and resolving disputes.

Optimum Assessment processes the personal data obtained solely for the above purposes. Where personal data will be used for other purposes, contact will be made prior to processing to provide notice of the changes to this statement and an opportunity for you to object to further processing.

Legal basis for processing

The aforementioned purposes each have their own legal basis for processing. These legal bases are:

  • The consent granted by you (including for sending the newsletter);
  • taking pre-contracting measures at your request (including for handling job applications);
  • the processing is necessary for the performance of a contract entered into with you (including the performance of our service agreements);
  • the processing is necessary for us to comply with a legal duty (including the legal obligation to keep and record, also from a tax point of view);
  • the processing is necessary for the protection of the legitimate interests of the controller or of a third party.

Where Optimum Assessment processes personal data on the basis of consent granted by you, you have the right to withdraw this consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on the consent before its withdrawal.

Where Optimum Assessment processes personal data based on the balancing of interests, Optimum Assessment will make the legitimate interests explicit and communicate them to data subjects.

If the processing is done on the basis of a legal or contractual obligation, or the processing is a necessary condition to conclude an agreement and/or the data subject is obliged to provide the personal data, the data subject will be informed about this before processing and it will also be made clear what the consequences are if the data subject will not provide these data. Naturally, Optimum Assessment requests only the personal data necessary to achieve the described purposes.

Retention periods

Optimum Assessment limits the storage of personal data to the strictly necessary period.

For this:

  • When processing personal data for the performance of a contract: as long as the contract is in force. Upon termination of the agreement, the data will be deleted unless the personal data is still relevant due to a post contractual relationship or otherwise.
  • For job applications: while the procedure is ongoing. After termination of the procedure, the data will be deleted after no later than four weeks, unless permission is given to retain the data. In that case, the data will be kept for another year.
  • For general contact requests: as long as there is continuous contact on one and the same subject. After a contact request is closed, the data is deleted after no more than four weeks.
  • When subscribing to the newsletter and/or other content publications: as long as one is subscribed to the relevant medium and permission for processing has been given. Upon cancellation or withdrawal of consent, the data will be deleted within four weeks.

Individual rights

Under privacy laws, you have several individual rights you can invoke. These are the right to inspect/copy, the right to rectification, the right to erasure (the right to be forgotten), the right to restrict processing affecting the data subject, the right to object and the right to data portability. These rights are not absolute, in the sense that they must always be complied with in all cases. Optimum Assessment will inform you within one month of making a request exercising a right about the action taken on that request or any extension required before action can be taken. Exercising your right(s) is in principle free of charge and can be done by submitting a request using the contact details provided in this statement. The right to object to use of data for direct marketing purposes is absolute, however. Unsubscribing to our newsletter or other commercial communications directly addressed to you will thus be followed up without fail.

Security measures

Optimum Assessment has taken appropriate technical and organizational measures to secure personal data against loss or any form of unlawful processing. Thus, only the necessary people have access to the data, and our security measures are effective and regularly monitored.
